Job Description and Duties

Effective July 1, 2025, in accordance with the applicable Memorandum of Understanding, the Personal Leave Program 2025 (PLP 2025) was implemented. PLP 2025 requires each full-time employee in Bargaining Unit 1 , and related Excluded, Exempt and Statutory Exempt employees, will have their base salary reduced by 3 percent and will receive 5 PLP 2025 leave credits monthly through June 2027. Salaries do not reflect the recent changes. Part-time employees are subject to the same conditions as full-time employees, on a prorated basis equivalent to their time-base. Permanent intermittent employees are subject to the same condition as full-time employees, based on the number of hours worked in the pay period.

Under the direction of the Chief Counsel, the Assistant Chief Counsel (ACC) is responsible for supervising a legal team for the California Correctional Health Care Services, Office of Legal Affairs. The ACC serves as counsel for the Department by working closely with the Chief Counsel and executive leadership. The ACC provides guidance on legal issues, policy reviews, regulatory changes, legislative proposals, and any other program needs of a legal nature.

The position is eligible for hybrid telework, in accordance with the Statewide Telework Policy and will be required to report to the office as needed/required. The successful candidate must reside in California upon appointment.

Special Requirements

Candidate must be an active member of the State Bar of California with broad and extensive experience in the practice of law (preferably more than six years legal experience acquired after admission to the Bar).

Desirable Qualifications

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:

  • Shall create and promote an equitable and inclusive workplace where diversity is celebrated and valued.
  • Knowledge of laws related to medical practice, provider and facility licensing, medical staff policy, patient privacy, ADA, consent, public records, conflicts of interest; hospital and physician network development and service contracts; employee discipline, disability management, labor laws, and other human resource concepts and principles; provider-payor disputes; state administrative and procurement policies and procedures; finance; construction; and other state laws, regulations and policies bearing upon the Receiver's duties.

  • Experience litigating cases in state and federal court, and in such administrative forums as the State Personnel Board, Office of Administrative Hearings, California Human Resources, and Public Employment Relations Board.

  • Background and experience in medical-legal issues, disabilities issues, ability to understand medical terminology and communicate with healthcare providers on medical issues. Background and experience in providing advice to governmental program areas and staff.

  • Background and experience with various California prison health care class actions and their requirements and inter-relationships (including Plata v. Newsom; Armstrong v. Newsom; and Coleman v. Newsom).

  • Familiarity and experience with California Business and Professions Code 800 et seq, Title 15 of the California Code of Regulations, and dealing with various healthcare regulatory boards.

  • Familiarity with the role of the federal court and the receivership created thereby in the Plata case, and the distinctions and division of responsibility for incarcerated patient care and housing between  CDCR and the Receiver's office.

  • Experience and ability to work in an unsupervised setting, and provide advice and suggest solutions to program staff in a short timeframe.
